Privacy Policy

This privacy and data processing policy establishes the manner in which the BudgetRate application collects, stores, processes, handles, manages, transfers, transmits and/or shares information, whether of a personal nature or not, that You supply or provide when you access and register in the Application or in any other channel developed in the future by BudgetRate, or in any way use the Application and/or the other services offered in BudgetRate.

The information about the User that BudgetRate collects, stores, handles, manages, transfers, transmits and/or shares may or may not be of a personal nature, may or may not be of a private character, and may even be information or data protected by the applicable personal data protection laws. Whatever the nature of the information, its processing, handling, storage, transfer, transmission and/or management by BudgetRate shall comply with the applicable personal data protection regulations.

The User, as owner or holder of the Personal Information, or as the subject to whom such information refers, shall have the rights granted by the respective applicable legislation in the corresponding jurisdictions where it operates. In Colombia, Users (holders of the Personal Information) shall have the rights established in Law 1581 of 2012 and in Law 1266 of 2008, and in any other regulation that modifies, replaces or complements them, in particular, but not limited to, Decree 1377 of 2013, such as the rights of access, revocation, deletion, updating, rectification, correction, cancellation and objection regarding their personal data and Personal Information.

“Sensitive Data” is understood to mean data that affects the User's privacy or whose improper use may give rise to discrimination, such as data revealing racial or ethnic origin, political orientation, religious or philosophical convictions, membership in trade unions, social organizations or human rights organizations, or organizations that promote the interests of any political party or that guarantee the rights and guarantees of opposition political parties, as well as data relating to health, sexual life and biometric data.

BudgetRate requires a user name and a login password in order to create an account, and roles are assigned for each project in which the User participates. The Application does not collect the device's geographic location, biometric data, or any of the categories of Sensitive Data described above.

As part of the normal operation of the Application, the User records financial and administrative information about their projects: budget line items, disbursements, execution periods, funding sources, tasks and notes. This information may include data of third parties linked to the project —suppliers, collaborators, investors and other participants— such as their name or business name, contact details and the bank accounts associated with the recording of payments. The User who enters such data is responsible for having the authorization of its owners to include it in the Application, and BudgetRate processes it solely to enable the recording and control of the disbursements of the corresponding project.

The Application allows files (PDF documents and images) to be attached to the different entities of the system, in order to support the budget records and to generate consolidated reports. These files are stored in the DEVCLOUD storage service, remain associated exclusively with the project from which they were uploaded, and are accessible only to the Users authorized in that project. BudgetRate also keeps an automatic history of the modifications made to the information, indicating what changed, when, and which User made the change, for traceability and audit purposes within the project.

BudgetRate sends email notifications to the Users responsible for tasks within a project, informing them about new assignments or status changes. For this purpose an external email delivery provider is used, to which only the recipient's email address and the content of the notification are transmitted. The information recorded in the Application is not shared with third parties for advertising or commercial purposes unrelated to the operation described in this policy.

BudgetRate undertakes to comply with its obligation of secrecy regarding personal data that constitutes Private Information (that is, data that is not public in nature), and with its duty to treat such data confidentially, and assumes, for these purposes, the technical, organizational and security measures necessary to prevent its alteration, loss, unauthorized processing or access. The Personal Information of each User's BudgetRate account is protected by a password for privacy and security. The User must prevent unauthorized access to their account and Personal Information by selecting and protecting the password appropriately and by limiting access to their device, logging out when finishing access to their account.
